We REINSTATE this appeal.

We VACATE this Court's order of July 31, 2023. The trial court need not hold the hearing or file the record and findings required by that order.

Before the Court is the joint motion for permanent abatement of this appeal due to the death of appellant. Attached to the motion is a press release from the Texas Department of Criminal Justice stating that on September 19, 2023, appellant was discovered deceased in his cell at the Coffield Unit. Accordingly, we GRANT the motion, and pursuant to Texas Rule of Appellate Procedure 7.1(a)(2), we PERMANENTLY ABATE this appeal.

We DIRECT the Clerk to send copies of this order to the Honorable Raquel Rocky Jones, Presiding Judge, 203rd Judicial District Court; David Laurel, Official Court Reporter of the 203rd Judicial District Court; and counsel for all parties.
