ORDER

This case is on the Court's June 12, 2023 trial calendar for Buffalo, New York. The parties had both expected to move for summary judgment on an issue that the Court recently decided in Farhy v. Commissioner, dkt. no. 10647-21. In an April 28, 2023 phone call, the parties agreed that it would be more efficient to wait on working this case until Farhy becomes final and unappealable.

The Court agrees, and it is therefore

ORDERED that this case is stricken from the Court's June 12, 2023 Buffalo trial calendar. It is also

ORDERED that this division of the court retains jurisdiction.

The Court will contact the parties when it is time to reactivate this case.
