Cassady v. State

Court of Criminal Appeals of Alabama
Feb 26, 1985
486 So. 2d 456 (Ala. Crim. App. 1985)

Opinion

1 Div. 741.

May 22, 1984. On Return to Remand January 22, 1985. Rehearing Denied February 26, 1985.

Appeal from Circuit Court, Mobile County; Edward A. McDermott — Trial Judge, James D. Sullivan — Sentencing Judge.

Leon F. Stamp, Jr., Mobile, for appellant.

Charles A. Graddick, Atty. Gen., and Gerrilyn V. Grant, Asst. Atty. Gen., for appellee.

Appellant Ronnie Cassady was convicted by a Mobile County jury for the sale of Dextroamphitimine sulfate and amobarbitol in violation of § 20-2-70, Code of Alabama (1975). He was sentenced to a term of 40 years in the penitentiary and fined $25,000.

This appeal raises an issue identical to the threshold issue raised in a companion case stemming from Cassady's conviction in three consolidated drug cases in Mobile County: Whether Cassady's conviction and sentencing was in violation of a pre-existing negotiated plea agreement with the Mobile County District Attorney's office.

We remand this case on the authority of Cassady v. State, 486 So.2d 449 (Ala.Crim.App. 1984), for an evidentiary hearing on the issue of whether a negotiated plea agreement existed with respect to this case and the terms of any such agreement. The trial judge should make written findings of fact on this issue and return same together with the transcript to this court.

REMANDED WITH INSTRUCTIONS.

All the Judges concur.

ON RETURN TO REMAND

Appellant Ronnie Cassady contends that the district attorney's office of Mobile County, Alabama violated a plea agreement he had made with them which covered this indictment and that it was error for the trial court to deny his motion to dismiss this indictment on that basis.

In the case of Cassady v. State, 486 So.2d 449 (Ala.Cr.App. 1985), decided this day on return to remand, the appellant presented this identical issue to this court. On authority of that case, we again hold that the trial court did not err when it denied the appellant's motion to dismiss the indictments.

OPINION EXTENDED; AFFIRMED.

All the Judges concur.
