Defendant Vitran Express, Inc's Motion for Judgment on the Pleadings or, alternatively, for Summary Judgment came on for hearing in this Court on May 29, 2012. Based on the papers filed relating to this Motion, and oral argument presented by the Parties, IT IS HEREBY ORDERED that Vitran's Motion is GRANTED, and thus Plaintiffs' claims are DISMISSED based on preemption of the Federal Aviation Administration Authorization Act.
