Judgment dismissing complaint reversed on the law and a new trial granted, costs to appellant to abide the event, on authority of Hart v. Travelers Insurance Co. ( 236 App. Div. 309; affd., 261 N.Y. 563). Lazansky, P.J., Young, Scudder, Tompkins and Davis, JJ., concur.
