Brown v. State

District Court of Appeal of Florida, Second District
Aug 31, 1990
566 So. 2d 71 (Fla. Dist. Ct. App. 1990)

Opinion

No. 90-02286.

August 31, 1990.

Appeal pursuant to Fla.R.App.P. 9.140(g) from the Circuit Court for Hillsborough County; Manuel Menendez, Jr., Judge.

Appellant Brown seeks to correct the judgment in circuit court case number 88-13073 to reflect that he was convicted of carrying a concealed weapon, a misdemeanor, rather than carrying a concealed firearm, a felony. See §§ 790.01(1), (2), Fla. Stat. (1989). The trial court's order, which denies Brown's motion, nevertheless appears to acknowledge the existence of scrivener error. Accordingly, we remand with instructions to correct the written judgment form.

FRANK, A.C.J., and PARKER and PATTERSON, JJ., concur.
