BROSIS PROPERTIES, LLC, BEAR CREEK LAND MANAGEMENT, LLC, TAX MATTERS PARTNER, Petitioner v. COMMISSIONER OF INTERNAL REVENUE, Respondent

ORDER

Mark V. Holmes, Judge.

This case was on the Court's October 24, 2022 trial calendar for Atlanta, Georgia. It is one of many syndicated conservation-easement cases before the Court, and all agreed that it made sense to try to let petitioner meet with IRS Appeals to try to settle the case or at least narrow what needs to be tried. We learned that this had not worked out, and spoke with the parties on April 26, 2023 on how to move forward. It turns out that there are new counsel on both sides, and they reasonably suggested that they work on informal discovery in the next three months to see whether they think they need to move to a pretrial-order track.

It is therefore

ORDERED that the parties file a joint status report on or before July 26, 2023 in which they describe their progress in informal discovery, their views on whether a trial will be necessary, and any foreseeable pretrial motions.
