Petition for Allowance of Appeal No. 164 MAL 2005 from the published opinion and order of the Commonwealth Court at 1524 CD 2004, dated January 25, 2005 affirmed to determination of backtime the order of the Board of Probation and Parole at 2706-H, dated June 22, 2004.


ORDER


AND NOW, this 28th day of June, 2005, the Application for Expedited Consideration or Remand and the Petition for Allowance of Appeal are hereby GRANTED and the order of the Commonwealth Court is REVERSED. Commonwealth v. Kyle, 582 Pa. 624, 874 A.2d 12 (2005).
