This case is currently calendared for trial at the remote Session of the Court commencing on February 27, 2023. On February 23, 2023, the Court held a telephone conference with the parties to discuss the status of this case and the propriety of calendaring the case for trial at a date and time certain. Upon due consideration, it is hereby
ORDERED that this case is calendared for trial (to be conducted remotely) at a date and time certain on Friday, March 3, 2023, at 1:00 p.m. (EST) during the February 27, 2023, remote Trial Session of the Court. The parties are excused from appearing at the calendar call of this Session commencing at 1:00 p.m. (EST) on February 27, 2023. All witnesses shall be present and testify to facts that are not stipulated. Additionally, if a party expects to use at trial any documents or materials (except for impeachment documents or materials) that are not already in the Stipulation of Facts or that have not already been filed with the Court as Proposed Trial Exhibits, they must be exchanged with (and received by) the opposing party as Proposed Trial Exhibits no later than Wednesday, March 1, 2023, at 5:00 p.m. (EST). Petitioner is directed to Guidance for Petitioners: During Trial (ustaxcourt.gov) regarding what to expect during trial.
The parties shall refer to the Notice of Remote Proceedings served on October 14, 2022, for the Zoomgov Meeting ID and Passcode.
This Order constitutes official notice thereof to the parties.
