Bird Lakes Dev. Corp. v. Meruelo

District Court of Appeal of Florida, Third District
Dec 7, 1993
626 So. 2d 239 (Fla. Dist. Ct. App. 1993)

Opinion

Nos. 92-59, 92-6 and 91-2646.

June 22, 1993. Rehearing Denied December 7, 1993.

An Appeal from the Circuit Court for Dade County; Eugene J. Fierro, Judge.

Holland Knight, and Daniel S. Pearson, Lucinda A. Hofmann and Lenore C. Smith, Miami, for appellant.

Fitzgerald, Charlip, Delgado, Befeler Portuondo, and Joseph Portuondo, for appellee Homero Meruelo.

Warren Jacobs and James C. Blecke, Miami, for appellee Gesyl Developers Corp.

Before HUBBART, GERSTEN, and GODERICH, JJ.

Because a trial court may not award appellate attorney's fees absent a mandate from the appellate court, Garcia v. Garcia, 570 So.2d 357 (Fla. 3d DCA 1990), we reverse the trial court's award of appellate attorney's fees to appellee Gesyl's attorney. Finding no merit in appellant's other contentions, we affirm the judgment for attorney's fees in all other respects.

Affirmed in part, reversed in part.
