Bethlehem Steel Corp. v. N.Y. State Division

Appellate Division of the Supreme Court of New York, Fourth Department
Jan 14, 1971
36 A.D.2d 566 (N.Y. App. Div. 1971)

Opinion

January 14, 1971

Present — Goldman, P.J., Del Vecchio, Witmer, Gabrielli and Henry, JJ.

Petition unanimously dismissed, on petitioners' consent, without costs. Respondents' cross motion for an order of enforcement granted, without costs. Memorandum: Petitioner Bethlehem Steel Corporation has not denied its failure to comply with the Commissioner's order as modified by the Appeal Board and has not alleged facts showing that it will comply therewith. There is a sufficient showing of need for the enforcement order and it should therefore be granted. (Cf. Matter of Glen Cove Municipal Civ. Serv. Comm. v. Glen Cove Nat. Assn. for Advancement of Colored People, 34 A.D.2d 956; Matter of State Division of Human Rights v. Togias, 35 A.D.2d 688.)
