This case is before the Court on respondent's motion to dismiss for failure to properly prosecute, filed August 27, 2024, and on petitioner's motion to proceed remotely, filed September 4, 2024, and heard on September 9, 2024, when the case was called from the calendar for trial during the Court's Chicago, Illinois, trial session. Petitioner Ezio Berrettini and counsel for respondent appeared and were heard. Counsel for respondent advised the Court that he did not object to petitioner's motion to proceed remotely.

Upon due consideration, and for cause appearing more fully in the transcript of the above-referenced proceedings, it is

ORDERED that respondent's motion to dismiss for failure to properly prosecute is denied without prejudice. It is further

ORDERED that petitioner's motion to proceed remotely is granted, in that it is

ORDERED that this case is restored to the general docket. It is further ORDERED that this case will be added to a future remote session of the Court in due course.
