444 So. 2d 42 (Fla. Dist. Ct. App. 1984)

Opinion

No. AR-144.

December 28, 1983. Rehearing Dismissed January 24, 1984.

Appeal from the Deputy Commissioner, Michael J. DeMarko.

Thomas F. Condon and Bruce A. McDonald of Emmanuel, Sheppard Condon, Pensacola, for appellants.

John L. Myrick of Kinsey, Myrick Troxel, Pensacola, for appellee.

The facts and the question of law presented in this appeal are virtually indistinguishable from those presented in Travelers Insurance Co. v. Taylor, 444 So.2d 39 (Fla. 1st DCA 1983). Accordingly, the workers' compensation order in this case is reversed on the authority of Taylor.

NIMMONS, J., concurs.

ERVIN, C.J., dissents.

I dissent for the same reasons expressed in Travelers Insurance Company v. Taylor, 444 So.2d 39 (Fla. 1st DCA 1983).
