There is presented upon this appeal the same question that was presented in the case of Rose v. Low ( 85 App. Div. 461), and for the reasons stated in the opinion in that case the order appealed from should be affirmed, with ten dollars costs and disbursements. Van Brunt, P.J., Patterson, Hatch and Laughlin, JJ., concurred.
