For the reasons discussed in the consolidated case of Brown v. Louisiana Indemnity Co., 96-1393 (La.App. 3 Cir. 4/23/97); 693 So.2d 270, the judgment of the trial court is affirmed. Costs of the appeal are assessed to the State of Louisiana, Through the Department of Transportation and Development in the amount of $2,713.01.

AFFIRMED.
