RICARDO ANTONIO BACA, Appellant v. THE STATE OF TEXAS, Appellee

On Appeal from the 182nd District Court Harris County, Texas
Trial Court Cause Nos. 1438467 , 1458501, 1402326

ORDER

Appellant is represented by retained counsel, Joe A. Spencer. Appellant's brief was due April 24, 2017. On April 23, Spencer filed a motion for voluntary dismissal of these appeals. See Tex. R. App. P. 42.2(a). This court denied the motion on May 2, 2017, because the motion was not personally signed by appellant. No further motion to dismiss has been filed, and no brief has been filed.

Accordingly, we order Joe A. Spencer to file a brief with the clerk of this court by June 7, 2017. If Spencer does not timely file appellant's brief as ordered, the court will issue an order abating the appeal and directing the trial court to conduct a hearing to determine the reason for the failure to file the brief and the consideration of sanctions, appointment of new counsel, or other appropriate relief.

This order does not preclude a motion for voluntary dismissal that complies with Texas Rule of Appellate Procedure 42.2(a).
