United States District Court, S.D. New York
Sep 30, 2002
02 Civ. 6441 (LAK) (S.D.N.Y. Sep. 30, 2002)

Opinion

02 Civ. 6441 (LAK).

September 30, 2002

ORDER

Defendants, by letter dated September 25, 2002, have raised certain discovery matters. Plaintiffs, by letter dated September 26, 2002, have taken issue with defendants' position and, moreover, objected to the Court's resolving a number of very straightforward and simple matters without "an opportunity to fully brief the issues."

The Court will treat defendants' letter as a motion to compel discovery under Rule 37(a). Plaintiffs may submit a brief in opposition provided it is served and filed no later than October 7, 2002. The parties should be mindful of the Court's intention to manage this, as any other, lawsuit with a minimum of senseless squabbling over discovery matters as well as of the provisions of Fed.R.Civ.P. 11 and 37(a)(4). Both sides would be well advised to resolve this dispute without further recourse to the Court.

SO ORDERED.
