ORDER
On April 12, 2017, the Court vacated its previous order to submit the appeal without the reporter's record and ordered court reporter Vielica Dobbins to file the reporter's record without prepayment of costs by May 12, 2017. Subsequent to that order, Ms. Dobbins filed a contest to appellant Kelly D. Hollingsworth's affidavit of inability to pay costs. On May 1, 2017, the trial court signed an order denying Mr. Hollingsworth's affidavit of inability to pay costs and ordering that Mr. Hollingsworth pay the cost of the reporter's record that he has requested.
In light of the trial court's May 1, 2017 order, Ms. Dobbins has filed a request that we reconsider our April 12, 2017 order. We GRANT Ms. Dobbins's request to the extent that we ORDER Ms. Dobbins to file, by June 9, 2017, either the reporter's record or written verification that Mr. Hollingsworth has not paid the fee for preparation of the reporter's record. We caution Mr. Hollingsworth that if the Court receives written verification of nonpayment, the Court will order the appeal submitted without the reporter's record.
