July 18, 1941.

Action in the district court for Olmsted county for personal injuries against the city of Rochester, the Minneapolis Brewing Company, A.W. Kutzky, and Harry Pederson. The case was tried before Vernon Gates, Judge, and a jury. After verdict of $3,000 for plaintiff, defendants city, Kutzky, and Minneapolis Brewing Company appealed from the judgment. Affirmed without opinion by equally divided court.
