ALLSTATE FIRE AND CASUALTY INSURANCE COMPANY, Appellant v. Curtis BROWN, Appellee

From the 37th Judicial District Court, Bexar County, Texas Trial Court No. 2018-CI-04336 Honorable Nicole Garza, Judge Presiding

ORDER

Beth Watkins, Justice

Appellant's brief was originally due on June 30, 2023. The appellee's first motion for extension of time was granted, extending the deadline for filing the brief to July 31, 2023. As of the date of this order, neither the brief nor a second motion for extension of time has been filed. We therefore ORDER appellant to file, by August 22, 2023:

1. its brief; and

2. a written response reasonably explaining: (a) its failure to timely file a brief; and (b) why appellee is not significantly injured by appellant's failure to timely file a brief.

If appellant fails to timely file a brief and the written response, we will dismiss the appeal for want of prosecution. See TEX. R. APP. P. 38.8(A); see also TEX. R. APP. P. 42.3(C) (ALLOWING INVOLUNTARY DISMISSAL IF APPELLANT FAILS TO COMPLY WITH COURT ORDER).
