ORDER

Plaintiff has applied for the Court's approval of the settlement of this Fair Labor Standards Act case pursuant to the Second Circuit's decision in Cheeks v. Freeport Pancake House, Inc., 796 F.3d 199 (2d Cir. 2015). Dkt. No. 66. Counsel also seeks approval of his fee request. Id. However, counsel relies entirely on what he claims is his agreement with Plaintiff without providing any contemporaneous time records. (Counsel does not provide a copy of the engagement letter with the contingency fee agreement.) For the reasons given by the Court in Hernandez v. Compass One LLC, 2021 WL 4639334 (S.D.N.Y. Oct. 6, 2021), the Court understands the law to require a review of the contemporaneous time records before a fee request is approved.
Accordingly, counsel is directed to provide copies of the contemporaneous time records (which may be redacted to exclude privileged material), if he wishes to press his request for fees.
