Agur v. Agur

Court of Appeals of the State of New York
Mar 23, 1973
296 N.E.2d 458 (N.Y. 1973)

Opinion

Submitted March 5, 1973

Decided March 23, 1973

Appeal from the Appellate Division of the Supreme Court in the Second Judicial Department, CHARLES J. BECKINELLA, J.

Kalman Finkel for motion.

Marttie L. Thompson, Stephen E. Gottlieb and Mary Jo Hoover opposed.

Motion granted and appeal dismissed, without costs, upon the ground that the question certified has been rendered moot. Since the Supreme Court has exercised its supervening jurisdiction to award custody of the child to the mother, the arbitrators would be without power to vary the disposition of custody.
