In State v. Altman, 181 N.J. Super. 539, 541, 438 A.2d 576, 577 (App. Div. 1981), the Superior Court of New Jersey, Appellate Division, held that an indigent criminal defendant would have leave to file a late notice of appeal nunc pro tunc if the defendant asked either private counsel or a public defender, within time, to file such a notice for him.
